Challenging Office Holders Remuneration

An Office holder is defined in the Insolvency Rules 2016 as “a person who under the Act or these Rules holds an office in relation to insolvency proceedings and includes a nominee”. This includes Trustees in Bankruptcy.

It is routine for people to believe that the Office Holder has charged to much for the work that they have carried out.

There are also specific time by which an application to challenge the Office holders fees must be made. For instance a person must apply at least 5 business days prior to the date of the annulment hearing, if the application is made under Insolvency Rule 10.134 . http://www.legislation.gov.uk/uksi/2016/1024/article/10.134/made

The Civil Procedure Practice Direction “Practice Direction – Insolvency Proceedings (Part 6) sets out the objective and principles of the how the Court will consider the matter.
